    I have a duplex in Nashville, and I specify in my lease that tenants are responsible for yard work. I let them use an old lawnmower that I keep in a shed behind the duplex. One of my tenants was mowing last week and ran over their foot. Sixteen stitches, probably on crutches for two weeks.

    Even though it’s in my lease that they accept all responsibility, they’re super bitter toward me now and threatening legal action. Anyone faced something similar? Should I just not supply a lawnmower in the future?

    Yikes! I’m sorry that happened, what a scary situation.

    I don’t think you should stop supplying the lawn mower if you’d like tenants to keep up the yard work, but I would share this particular story with tenants at the lease signing to ensure they understand clearly what you mean.

    When I initially started renting I did the same, lawnmower, weed eater, rakes and all things needed. The tenant failed to do regular maintenance my house looked a mess. At lease signing we upped the rent and added a lawn service. We found this to be the easiest solution. I work in insurance and so does my wife. While you can write a lease to say it is not your responsibility it doesn’t stop a suit. We didn’t want the hassle.

      Yep, that’s pretty much where I’m at – providing the equipment just feels like taking on too much risk! Thanks for the perspective, good to hear from an insurance-minded investor.

    Anonymous, My husband and I have been renting for 32 years. We stay away from providing anything for our tenants. When “things” hit the fan, you are responsible for the conditions of the items that you own. It is best to leave any type of supplies, tools, etc. up to the tenant, then they own the full liability. You could loan them some tools to do some repairs and if they are injured it can come back on you. We do not provide anything for them except the building. This keeps you safe from legal situations. Good luck. Yes I do agree on the lawn service!
